Welcome to CIVIL (“we,” “us,” or “our”). These Terms of Service (“Terms”) govern your use of our website at johnritchycivil.com and the marketing subscription services we provide. By subscribing to or using our services, you agree to these Terms. If you do not agree, please do not use our services.

1. Services Overview

CIVIL provides unlimited marketing, graphic design, and web development services to real estate developers through monthly subscription plans. Our services include but are not limited to brand identity, digital advertising, website development, print design, signage, and marketing strategy. The specific deliverables and turnaround times depend on the subscription plan selected.

2. Subscription Plans

We offer multiple subscription tiers, each with different service levels, turnaround times, and pricing. Plan details, pricing, and features are listed on our website and may be updated from time to time. By subscribing, you agree to the recurring monthly fee associated with your chosen plan. Billing occurs on a 31-day cycle from your subscription start date.

3. Requests and Deliverables

Once subscribed, you may submit unlimited requests through our designated project management platform. Requests are fulfilled sequentially unless your plan includes concurrent request capacity. We aim to deliver completed work within the turnaround time specified for your plan (typically 24 to 48 hours for standard requests). More complex requests may require additional time, and we will communicate timelines as needed.

4. Revisions

All subscription plans include unlimited revisions. We will refine deliverables until you are satisfied with the results. Revisions must relate to the original request scope. Requests that significantly change the original brief may be treated as a new request.

5. Intellectual Property

Upon full payment for the applicable billing period, all deliverables created for you become your exclusive property. You receive full ownership and rights to use, modify, and distribute the work as you see fit. We retain the right to showcase completed work in our portfolio unless you request otherwise in writing.

6. Payment Terms

Subscription fees are billed monthly at the start of each 31-day billing cycle. Payment is due upon invoice. We accept major credit cards and other payment methods as indicated at checkout. Late or failed payments may result in service suspension until the balance is resolved.

7. Pause, Downgrade, and Cancellation

You may pause, downgrade, upgrade, or cancel your subscription at any time. When you pause your subscription, your remaining days are preserved and can be resumed at your convenience. Cancellation takes effect at the end of your current billing cycle. There are no long-term contracts or cancellation fees.

8. Risk-Free Trial and Refund Policy

Every new subscription includes a 7-day risk-free trial period. If you determine the service is not the right fit within the first 7 days, you will receive 75% of your initial payment back, no questions asked. 9. Client Responsibilities

To ensure timely delivery, you agree to provide necessary materials, brand guidelines, feedback, and approvals in a reasonable timeframe. Delays in providing required information may affect delivery timelines. You are responsible for ensuring that any materials you provide (logos, images, text) do not infringe on third-party intellectual property rights.

10. Confidentiality

We treat all client information, business strategies, and project details as confidential. We will not share your proprietary information with third parties without your written consent, except as required by law. This obligation survives the termination of our service agreement.

11. Limitation of Liability

Our services are provided on an “as-is” basis. While we strive for excellence in every deliverable, we do not guarantee specific business outcomes such as lead generation numbers, occupancy rates, or revenue increases. Our total liability for any claim arising from our services is limited to the amount paid by you for the billing period during which the claim arose.

12. Services Not Covered

For efficiency and quality purposes, certain services fall outside our subscription scope, including complex custom packaging, market study research, WordPress plugin development, and extensive book or magazine design. If you have questions about whether a specific request is covered, please contact us before submitting.

13. Modifications to Terms

We may update these Terms from time to time. Material changes will be communicated via email or through our website. Your continued use of our services after changes are posted constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by the laws of the Province of Quebec, Canada. Any disputes arising from these Terms or our services will be resolved in the courts of Montreal, Quebec.
